Uganda Prisons Commissioner assures MPs on medical care for Besigye and Lukwago

Uganda Prisons Commissioner General Johnson Byabashaija has assured Members of Parliament that inmates requiring specialized medical attention are permitted to consult their own physicians. Speaking before the Committee on Defence and Internal Affairs on Thursday, 06 August 2026, Byabashaija addressed concerns regarding the health of high-profile remandees, including Dr Kizza Besigye and Erias Lukwago.

The briefing, chaired by Hon. Robina Rwakoojo, followed inquiries from lawmakers about the adequacy of prison medical services. Kampala District Woman MP Hon. Shamim Malende questioned whether prisoners on strong medication were receiving sufficient care, while Hon. Joseph Ssewungu noted that medical reports for Erias Lukwago from Mulago National Referral Hospital might not be fully reflected in communications to the Judiciary.

Byabashaija responded that the prison service remains flexible and relies on medical recommendations. He stated that unconvicted inmates can access personal doctors and visit preferred health facilities, noting that some inmates have already been taken to private clinics for specialized testing. He added that if the prison cannot manage a specific condition, inmates can be referred to Mulago or other suitable hospitals.

Addressing mental health, the Commissioner General said the service has created a dedicated ward for mentally ill inmates and receives support from Butabika National Referral Mental Hospital. Plans are currently being finalized to build a specialized mental health facility for prisoners at Butabika. He also noted that many suspects enter the system without prior psychiatric assessments.

Byabashaija highlighted prison congestion as a major issue, citing delays in the criminal justice system where some individuals wait up to 12 years for trial. He explained that the service uses quarterly Prison Form 30 submissions to notify the Judiciary and the Director of Public Prosecutions about inmates who have overstayed on remand. He advocated for more non-custodial measures for low-risk offenders to ensure prisons are reserved for those who threaten public security.

Regarding infrastructure, the Commissioner General clarified that the planned relocation of Luzira Maximum Security Prison is still a concept, as an investor has not yet been secured for the project.
